SDA Launches $150 million Class Action Against ALDI Banner

Every minute you work for your employer counts. If you’re not being paid for all time worked, this may be a breach of your workplace entitlements.

The SDA knows that this hasn’t been the case at ALDI.

That's why we’ve launched a Class Action against ALDI for requiring and expecting workers to work before or after their shifts without pay.

This is the result of a nationwide investigation we’ve been conducting at ALDI. Our investigation has found that this practice isn’t limited to a few workers or a few stores, it happened right across ALDI, from its supermarkets to its distribution centres.

We’re alleging in the Federal Court that ALDI systemically underpaid 20,000 current and former supermarket and distribution centre workers an estimated $150 million in wages over the past six years by:

  • Instructing or requiring workers to do work duties without pay before their rostered shift
  • Instructing or requiring workers to do work duties without pay after their rostered shift
  • Setting up a clocking system that automatically 'rounded’ clocking times to rob workers of up to 20 minutes a day.

This case follows on from a Federal Court case ran by the SDA in 2022, which found that ALDI underpaid workers at an NSW distribution centre by directing them to start work 15 minutes before their rostered start time.

ALDI has had its chance to backpay all other workers and they’ve been too slow off the mark to fix this. Workers deserve to be paid in full for all work done at ALDI.

We’ve lodged this class action to seek proper compensation for all ALDI workers and to ensure this $150 million is returned to workers like you.

How can I get involved?

If you’ve worked at ALDI any time in the past 6 years, you’re automatically part of our Class Action and eligible for compensation. This includes store assistants, warehouse employees, and salaried store managers.

What’s next?

We’re going to be working to resolve this as quickly as possible to deliver full compensation to workers.
Federal Court cases like this can however be complex and can take several years to resolve. We will keep you updated as this case progresses.

The amount of compensation per worker will vary based on length of service, classification and rates of pay.
